Ordinance 119 – The Snow Emergency Ordinance

AN ORDINANCE PROHIBITING ALL PARKING ON PUBLIC ROADS WITHIN STROUD TOWNSHIP DURING SNOW EMERGENCY. BE IT ORDAINED AND ENACTED by the township of Stroud, Monroe County, Pennsylvania and it is hereby Ordained and Enacted by the Supervisors pursuant to act of the General Assembly of the Commonwealth of Pennsylvania, Act No. 93, enacted June 12, 1968.

STROUD TOWNSHIP HEREBY ORDAINS AS FOLLOWS:

SECTION 1. SHORT TITLE

.

This Ordinance shall be known and cited as “The Snow Emergency Ordinance.”

.

SECTION 2. DEFINITIONS

.

A) SNOW EMERGENCY OR SNOW EMERGENCIES. Shall be whenever there shall be a snow fall of a depth of one inch or more

.

B) PERSON. The word “person” as used in this Ordinance, shall mean and include any natural person, partnership, firm, association or corporation.

The singular shall include the plural and the masculine shall include the feminine.

SECTION 3. GENERAL REGULATIONS

.

No person shall park or leave any motor vehicle unattended on any public road within the township of Stroud between the first day of November and the first day of April of the following year, during snow emergency or snow emergencies.

SECTION 4. ENFORCEMENT

.

A) Any person who shall violate this ordinance shall be notified by certified mail return receipt requested and thereafter such person again violating this Ordinance shall be guilty of a summary offense, punishable by a fine of not less than $25.00 nor more than $300.00 or by imprisonment of not less than 10 days or more than 30 days or both such fines and imprisonment.

B) The application of the above penalty shall not be held to prevent the township from compelling the owner of such a motor vehicle to be removed from said public road and upon his failure to so remove forthwith when so notified, the township shall have the right to remove the same and it shall have a lien against the vehicle for the amount of the expenses incurred by the township in the removal.

SECTION 5. INCONSISTENT ORDINANCE REPEALED

All other Ordinances or parts of Ordinances, insofar as the same are inconsistent with the provisions of this Ordinance, shall be, and the same are hereby repealed.

SECTION 6. DATE OF EFFECT

.

This Ordinance shall take effect five (5)days after the date of publication.
